Welcome to the family! We’ve created 90DAYMEMORY to bring back the magic of physical, tangible snapshots. We aren't just a tech company; we are a "memory company." Because our thermal photobooths are unique, we’ve put together this detailed guide so you know exactly how your device works and what we’ve agreed to together.
By purchasing, unboxing, or using your 90DAYMEMORY Unit, you are agreeing to these terms. Let’s dive in!
1. CUSTOM-TAILORED ARTISTRY & SALES POLICY
Every 90DAYMEMORY Unit is more than just a box of electronics; it is a custom-calibrated device. We don’t just pull these off a shelf; we prepare each one specifically for the person who ordered it.
Custom-Tailored Experience: We adjust software "recipes," calibrate printer heads, and configure specific internal modules based on your order (including any optional cloud features).
All Sales are Final: Because each Unit is customized and "tailored to the recipient," we do not offer returns, exchanges, or "change of mind" refunds. Once your Unit begins its journey to you, it belongs to you.
Our Quality Commitment: While sales are final, we are obsessed with quality. If your custom Unit arrives with a manufacturing defect, we will jump in to make it right (see Section 5).
2. DATA STRUCTURE: WHERE THE MEMORIES LIVE
We’ve designed our data structure to be "Privacy-First" for the user, while allowing our brand to grow and share the joy of what our booths can do.
A. Local-Only Storage (The Standard)
By default, your Unit is a standalone vault.
Physical Residency: All digital records of the images you capture live exclusively on the internal hardware memory of the device.
Your Control: Since we don't have a "cloud backdoor" to your standard device, we can't see your photos remotely. You are the sole curator and guardian of the data living inside your Unit.
B. Our Access & Promotional Usage Rights
This is an important part of how we keep 90DAYMEMORY growing! While the photos are stored on your device, by using the hardware, you grant 90DAYMEMORY a perpetual, worldwide, royalty-free, and irrevocable license to access and use the imagery captured by the Unit.
Where We Use It: We love showing off how much fun people are having! We reserve the right to use shots for our official website, Instagram, TikTok, marketing campaigns, and any other promotional materials. * Unlimited Scope: This isn't just for social media; we may use imagery for advertisements, brand storytelling, and product demonstrations to help show new customers the magic of thermal printing.
C. The "Optional Cloud" (By Request)
If you specifically requested and purchased the Cloud Connectivity Add-On:
Connection: Your Unit will be modified to transmit images to a secure viewing portal.
Your Responsibility: You are in charge of the Wi-Fi network security and your portal passwords. Think of us as the "delivery truck" for your digital files—once they reach your portal, the keys are in your hands.
3. WHOLESALE & BULK ORDERS
We love seeing our Units in bars, hotels, weddings, and retail spaces! For those ordering in bulk (5+ Units):
Custom Production: Bulk orders are subject to specific lead times as we customize an entire fleet of devices for you.
Commercial Compliance: If you are a wholesale partner placing Units in public spaces, you are responsible for ensuring your guests are aware of the photobooth's presence and our usage terms.
Resale: You may only resell Units if you are an authorized 90DAYMEMORY partner.
4. ZERO-LIABILITY & "AS-IS" HARDWARE
We want you to have the best experience possible, but it’s important to understand the limits of what we can be responsible for.
User Conduct: You are the captain of your photobooth. 90DAYMEMORY is not liable for the content you choose to capture. Whether it’s a privacy dispute with a guest or the capture of sensitive imagery, that responsibility rests 100% with the Customer.
Consent: You agree to ensure that everyone who uses your Unit knows their photo is being taken. We are not responsible for any "unauthorized" snapshots.
Thermal Aging: Thermal prints are a "living" medium. They can fade if left in a hot car or in direct sunlight. 90DAYMEMORY is not liable for the natural fading or degradation of your physical prints over time.
Indemnification: You agree to protect and "hold us harmless." If someone sues because of how you used your Unit, you agree to cover the costs and keep 90DAYMEMORY out of the dispute.
5. THE 90-DAY HARDWARE PROMISE (WARRANTY)
If your Unit has a "hiccup" that wasn't your fault, we’ve got your back.
The Warranty: We offer a 90-day limited warranty on manufacturing defects (like a printer head failure or a sensor glitch).
What Voids It: If you drop the Unit, spill a drink on it, or—most importantly—attempt to open the casing or "hack" the software, the warranty is immediately voided. We’ve custom-tailored the "recipe" inside; tampering with it releases us from all support obligations.
6. INTELLECTUAL PROPERTY
90DAYMEMORY is a unique brand with proprietary tech.
Our Tech: The software, the "look and feel" of the prints, and the hardware design belong to us.
No Clones: You agree not to reverse-engineer, decompile, or attempt to recreate the 90DAYMEMORY hardware or software for commercial use.
